While it is impossible to list every possible area of practice at our Phoenix law office, or every conceivable issue that might come up in representation, below we give a general listing of types of work done by our firm, grouped by the four broad areas of our practice. Construction: Administrative regulation of licensed professionals (e.g., Registrar of Contractors, Department of Real Estate); Construction litigation; Mechanic’s and Materialman’s liens drafting and foreclosure, real property transactions, zoning and permit issues, bid protests, WBE/MBE status, contract writing
Corporate: Business entity formation; Maintenance, including attending meetings, drafting minutes, resolutions, and various agreements; Buy-sell agreements; Business asset transfer agreements; Corporate winding up and dissolution; Business Ch. 7 bankruptcy.
Commercial: General commercial litigation (breach of contract); Fraud and other business tort litigation; Collections and loss recovery; Foreclosure, eviction and repossession (replevin); Business transactions and contract drafting; lease review and negotiation; Arbitration and mediation (both as counsel to parties and as the arbitrator/mediator); some employment and labor issues.
Consumer: Personal injury and Insurance law; Personal Ch. 7 bankruptcy; Collections defense and consumer credit, including issues with the Fair Credit Reporting Act and Fair Debt Collections Practices Act; Some employment and labor issues.
Personal Injury: Personal injury law covers a variety of injuries that can be inflicted upon a person
Bankruptcy: Smith & Craven have experience representing creditors in bankruptcy. For secured creditors we can provide assistance in seeking relief from the automatic stay in bankruptcy so that the creditor can liquidate the property. We also provide assistance and representation in adversary proceedings (essentially lawsuits) in bankruptcy court, and can assist with post-relief foreclosure, repossession, and eviction.
We are presently licensed in Arizona, California, Hawaii, Colorado, North Carolina, and New York, though our focus is on the Southwest corner of the United States.
